Adoptable Terms and Conditions of UseIntroduction and Acceptance

By placing a bid (Bidding), purchasing (Purchasing), or receiving (Receiving) this Adoptable character from the designer (Designer : Txnawa), the buyer/recipient is deemed to have read, understood, and agreed to all terms and conditions stated below without exception. In the event of any violation of these terms, the designer reserves the right to revoke part or all of the character’s usage rights (Usage Rights).1. Usage Rights1.1 Design Ownership Transfer :
Purchasing this Adoptable constitutes a transfer of ownership and usage rights of the character design (Character Design Ownership) to the buyer in full, under the conditions stated in this agreement.1.2 Personal Use :
The buyer may use the character for any personal purposes (such as OC use, trades, or gifts).1.3 Modification :
The buyer is free to modify the character, including but not limited to appearance, colors, outfits, and other details.1.4 Commercial Use :
Commercial usage rights (such as merchandise production or monetization of related artwork) are granted only to buyers who reach the Auto Buy (AB) price. If the purchase does not reach the AB price, usage rights are strictly limited to personal use only.ㅤ2. Copyright and Image License2.1 Original Artwork Copyright :
The copyright of the original artwork remains solely with the creator (Designer : Txnawa).2.2 Buyer’s Image License :
Although the copyright of the original artwork is not transferred, the buyer is granted a license to use, reproduce, and distribute the provided image files freely for personal or commercial purposes (as specified in Section 1.4). The buyer may upload the images to platforms, print them, or provide them to other artists for use as references.2.3 Designer’s Right to Display :
The designer retains the right to use the original artwork for display, portfolio purposes, or other promotional uses without prior notice to the buyer.ㅤ3. Restrictions and Prohibitions3.1 Design Claim :
The buyer may not claim to be the original designer of this character.3.2 Credit Requirement :
The buyer should credit the original designer (Design by Txnawa) whenever the original artwork is used or shared publicly.3.3 Resale / Transfer :
The buyer may not resell the character at a higher price than the original purchase price (no price inflation), unless additional value has been added through commissioned artwork or extra art. Any resale or transfer must follow the same terms and conditions stated in this agreement.3.4 AI Usage Prohibition :
The original artwork or any images related to this character may not be used for AI training under any circumstances.ㅤ4. Payment and Delivery4.1 Payment Period :
Full payment must be completed within the specified timeframe at the original point of sale after the auction ends or the purchase is confirmed.4.2 Payment Plan :
Payment plans are available only for purchases that reach the Auto Buy (AB) price. The buyer will receive the files and full character usage rights only after the total amount has been paid in full.Default on Payment : If the buyer fails to meet payment deadlines or cannot complete the agreed payment plan, the designer reserves the right to cancel the sale. All deposits and previously paid installments will be non-refundable in all cases.

การเสนอราคา (Bidding), การซื้อ (Purchasing), หรือการรับโอน (Receiving) Adoptable ตัวละครนี้จากผู้ออกแบบ (Designer: Txnawa) ถือว่าผู้ซื้อ/ผู้รับโอนได้อ่านและยอมรับข้อตกลงและเงื่อนไขทั้งหมด ที่ระบุไว้ด้านล่างนี้โดยไม่มีเงื่อนไข หากมีการละเมิดข้อตกลง ผู้ออกแบบมีสิทธิ์ในการเพิกถอนสิทธิ์การใช้งานตัวละคร (Usage Rights) บางส่วนหรือทั้งหมด1. สิทธิ์การใช้งาน (Usage Rights)1.1 การโอนสิทธิ์ในดีไซน์ : การซื้อ Adoptable นี้เป็นการโอนสิทธิ์ในการเป็นเจ้าของและใช้งานดีไซน์ตัวละคร
(Character Design Ownership) ให้แก่ผู้ซื้ออย่างสมบูรณ์ภายใต้ข้อกำหนดที่ระบุไว้ในข้อตกลงนี้1.2 การใช้งานส่วนบุคคล : ผู้ซื้อสามารถใช้ตัวละครนี้เพื่อวัตถุประสงค์ส่วนบุคคลได้ทุกรูปแบบ (เช่น OC, Trade, Gift)1.3 การดัดแปลง : ผู้ซื้อมีสิทธิ์ในการดัดแปลงตัวละคร รวมถึงรูปลักษณ์, สี, เครื่องแต่งกาย, และรายละเอียดอื่น ๆ ได้อย่างอิสระ1.4 สิทธิ์เชิงพาณิชย์ (Commercial Use): สิทธิ์ในการนำตัวละครไปใช้ในเชิงพาณิชย์ (เช่น การทำสินค้า, การหารายได้จากงานศิลปะที่เกี่ยวข้อง) จะมอบให้เฉพาะผู้ที่ทำการเสนอราคาสูงสุดถึงราคา Auto Buy (AB) เท่านั้น หากผู้ซื้อไม่ได้ประมูลถึงราคา AB สิทธิ์การใช้งานจะถูกจำกัดเฉพาะการใช้งานส่วนบุคคลเท่านั้นㅤ2. ลิขสิทธิ์ (Copyright) และการอนุญาตใช้ภาพ2.1 การสงวนลิขสิทธิ์งานต้นฉบับ : ลิขสิทธิ์ในผลงานศิลปะต้นฉบับ (Original Artwork Copyright) จะยังคงเป็นของผู้สร้างสรรค์ (Designer: Txnawa) แต่เพียงผู้เดียว2.2 การอนุญาตใช้ภาพสำหรับผู้ซื้อ (Buyer's Image License) : ถึงแม้ว่าลิขสิทธิ์ในภาพต้นฉบับจะไม่ได้ถูกโอน ผู้ซื้อจะได้รับสิทธิ์การใช้งาน (License) ในการใช้, เผยแพร่, และทำซ้ำไฟล์ภาพที่ได้รับอย่างเต็มที่ เพื่อวัตถุประสงค์ในการใช้งานส่วนตัวหรือเชิงพาณิชย์ (ตามข้อ 1.4) ผู้ซื้อสามารถนำภาพไปใช้ลงสื่อ, พิมพ์, หรือมอบให้กับศิลปินท่านอื่นเพื่อใช้เป็นแบบในการวาด (References) ได้2.3 สิทธิ์ในการเผยแพร่ผลงานต้นฉบับของผู้ออกแบบ : ผู้ออกแบบมีสิทธิ์ในการใช้ภาพผลงานศิลปะต้นฉบับเพื่อวัตถุประสงค์ในการเผยแพร่ผลงาน, การจัดพอร์ตโฟลิโอ (Portfolio), หรือการโปรโมตอื่น ๆ โดยไม่จำเป็นต้องแจ้งให้ผู้ซื้อทราบล่วงหน้าㅤ3. ข้อจำกัดและข้อห้าม (Restrictions and Prohibitions)3.1 การอ้างสิทธิ์การออกแบบ : ผู้ซื้อห้ามแอบอ้างว่าเป็นผู้ออกแบบตัวละครต้นฉบับนี้3.2 การให้เครดิต : ผู้ซื้อควรให้เครดิตผู้ออกแบบต้นฉบับ (Design by Txnawa) ทุกครั้งที่นำภาพงานศิลปะต้นฉบับไปใช้หรือเผยแพร่3.3 การขายต่อ/ส่งต่อ : ผู้ซื้อห้ามขายต่อตัวละครในราคาที่สูงกว่าราคาที่ตนเองซื้อมา (ห้ามบวกราคาเพิ่ม) เว้นแต่มีการเพิ่มมูลค่าด้วยงานศิลปะ (Art/Commissions) ที่ซื้อมาเพิ่มเติม การขายต่อหรือส่งต่อต้องเป็นไปตามเงื่อนไขการใช้งานที่ระบุไว้ในข้อตกลงนี้3.4 การนำไปฝึกฝน AI : ห้ามนำภาพงานศิลปะต้นฉบับหรือภาพอื่น ๆ ที่เกี่ยวข้องกับตัวละครนี้ไปใช้ในการฝึกฝนโมเดลปัญญาประดิษฐ์ (AI Training) โดยเด็ดขาดㅤ4. การชำระเงินและการส่งมอบ (Payment and Delivery)4.1 ระยะเวลาการชำระเงิน : ผู้ซื้อต้องชำระเงินเต็มจำนวนภายในระยะเวลาที่กำหนด ณ จุดขายต้นทาง หลังสิ้นสุดการประมูลหรือได้รับการยืนยันการซื้อ4.2 การผ่อนชำระ (Payment Plan) : การผ่อนชำระสามารถทำได้เฉพาะกรณีที่มีการเสนอราคาถึงราคา Auto Buy (AB) เท่านั้น ผู้ซื้อจะได้รับไฟล์งานและสิทธิ์ในการใช้งานตัวละครอย่างสมบูรณ์หลังจากที่ได้ชำระเงินครบถ้วนตามจำนวนเต็มแล้วเท่านั้นการผิดนัดชำระ : หากผู้ซื้อผิดนัดชำระตามกำหนดงวด หรือไม่สามารถชำระครบถ้วนตามแผนที่ตกลงไว้ ผู้ออกแบบมีสิทธิ์ในการยกเลิกการขาย โดยจะไม่มีการคืนเงินมัดจำและยอดผ่อนชำระทั้งหมดที่ชำระมาก่อนหน้าทุกกรณี
